Málaga Directory is an activity of Lee Daniel Nolan, a sole trader trading as Málaga Web Designs.

1. Acceptance of Terms

Welcome to Málaga Directory. By accessing and using our website, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms and Conditions govern your use of our business directory service for discovering restaurants, hotels, attractions, and other businesses in Málaga, Spain.

2. Description of Service

Málaga Directory provides:

• A comprehensive directory of local businesses in Málaga, Spain
• Search and filtering capabilities to find specific businesses
• Business information including contact details, descriptions, and categories
• Featured business listings and promotional content
• Affiliate booking links and widgets from third-party travel partners (see Section 9)
• Newsletter services for updates and local business news
• User-generated content such as reviews and ratings

3. User Responsibilities

3.1 Acceptable Use

You agree to use our service only for lawful purposes and in accordance with these Terms. You agree not to:

• Submit false, misleading, or inaccurate information
• Impersonate any person or entity
• Violate any applicable local, state, national, or international law
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Attempt to gain unauthorized access to our systems
• Use automated systems to access or collect data from our website
• Interfere with or disrupt our services or servers

3.2 Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Business Listings

4.1 Listing Accuracy

While we strive to maintain accurate business information, we cannot guarantee the accuracy, completeness, or timeliness of all listings. Business information is provided by third parties and may change without notice.

4.2 Business Owner Rights

Business owners may:

• Request updates to their business information
• Claim ownership of their business listing
• Request removal of inaccurate information
• Upgrade to featured listing status

4.3 Listing Removal

We reserve the right to remove any business listing that violates our guidelines or applicable laws, or for any other reason at our sole discretion.

5. User-Generated Content

5.1 Reviews and Ratings

Users may submit reviews and ratings for businesses listed in our directory. By submitting content, you grant us a non-exclusive, royalty-free license to use, modify, and display your content.

5.2 Content Guidelines

All user-generated content must:

• Be based on genuine personal experience
• Be respectful and constructive
• Not contain offensive, discriminatory, or inappropriate language
• Not violate any third-party rights
• Not contain promotional or commercial content

5.3 Content Moderation

We reserve the right to review, edit, or remove any user-generated content that violates these terms or our community guidelines.

6. Intellectual Property

The content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to our website are protected under applicable copyrights, trademarks, and other proprietary rights.

You may not modify, copy, distribute, transmit, display, reproduce, or create derivative works from our website without our express written permission.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of our service, to understand our practices regarding the collection and use of your personal information.

8. Disclaimers and Limitations

8.1 Service Availability

We do not guarantee that our service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to our service.

8.2 Third-Party Links

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites.

8.3 Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our service.

9. Advertising, Featured Listings and Affiliate Links

9.1 Featured Listings

Featured listings are paid promotional placements that receive enhanced visibility in our directory. Featured status does not imply endorsement of the business.

9.2 Paid Advertising Orders and Prices

Our self-service advertising plans are one-time purchases for a 30-day campaign in one agreed category. The plan, placement, duration and total price are shown before you continue to Stripe Checkout. Published prices include any tax that is applicable to the transaction; we do not add an extra tax amount at checkout. There is no subscription or automatic renewal.

Stripe processes the payment on our behalf. We do not receive or store your full card number, card security code or other complete payment credentials. A successful payment reserves the order for our review but does not automatically activate or publish a campaign.

9.3 Availability, Creative Approval and Campaign Start

All placements remain subject to availability, category relevance and creative approval. We normally contact the advertiser within one to two business days to confirm the placement, proposed start date and creative requirements. The 30-day campaign period begins only when the approved creative is published.

Advertising must be lawful, accurate, appropriately substantiated and suitable for our audience. We may reject or request changes to content that is misleading, unlawful, discriminatory, infringing, unsafe, technically unsuitable or inconsistent with the directory's standards. We will not substitute a materially different placement or start date without the advertiser's agreement.

9.4 Cancellation and Refunds

• You may cancel for a full refund at any time before the creative has been approved and the campaign has been scheduled.
• If we cannot provide the purchased placement, cannot approve the proposed creative after reasonable attempts to agree changes, or cannot agree a suitable start date, we will offer a reasonable alternative. If you do not accept it, we will refund the payment in full.
• After a campaign has gone live, payments are normally non-refundable. If we fail to deliver a material part of the agreed campaign for reasons within our control, we will offer an extension, replacement placement or an appropriate partial or full refund.
• Approved refunds are returned through Stripe to the original payment method. The time taken to appear is controlled by the customer's bank or payment provider.

To cancel or raise a delivery issue, email ads@malaga-directory.com with the advertiser name, business name and order details. Nothing in this policy limits any cancellation, withdrawal, refund or other right that cannot lawfully be excluded. Although advertising is ordinarily purchased for business purposes, any mandatory consumer rights that apply to a particular customer remain unaffected.

The statutory response period is 10 working days. Keep a copy of the form and evidence of submission. You do not need to purchase a service or pay to request a complaints form.

Electronic ordering

Select a plan, complete and review the form, accept the terms and continue to Stripe’s secure payment page. Correct any errors before paying; contact us for corrections afterwards. Ordering is available in English and Spanish. We retain your order and acceptance record; you may request a copy and print or save these terms. Receipt is acknowledged on the payment confirmation page; we then email you within one to two business days to agree campaign details.

If you purchase as a consumer

If purchasing outside your business or profession, you may withdraw within 14 calendar days of concluding the contract without giving a reason. Send an unequivocal statement to the operator’s email or postal address. You may use: “I withdraw from advertising contract [reference], concluded on [date]. Name, address and date.” This model is optional. Refunds are made within 14 days of notification by the same payment method unless expressly agreed otherwise, without refund fees.

We will not start the service during this period without your express request. If you request early performance and then withdraw, a proportionate charge for service already provided may apply as permitted by law. The right is lost on full performance only if you previously gave express consent and acknowledged that consequence. These consumer rules do not apply to purchases for your business or profession.

9.5 Affiliate Links and Commissions

Málaga Directory participates in affiliate and referral programmes operated by third-party travel partners — including, but not limited to, GetYourGuide, Viator and Stay22 — which sell tours, tickets, activities and accommodation. Some of the links, buttons, booking widgets and embedded maps shown on our site are affiliate links.

If you click one of these links or interact with one of these widgets and then make a booking or purchase, we may earn a commission from the third-party provider. This is at no additional cost to you — you pay the same price you would have paid otherwise. These commissions help fund the running of the directory and keep it free to use.

Wherever affiliate content appears, we display a clear disclosure next to it. The presence of affiliate or advertising content on any page — including a specific business listing page — does not imply endorsement of, affiliation with, or a recommendation of that business, and is independent of our editorial directory listings.

We do not control the products, prices, availability, or booking terms offered by our affiliate partners. Any purchase you make through an affiliate link is a contract solely between you and that third-party provider, subject to their own terms and privacy policies. We are not responsible for the fulfilment of, or any issues arising from, those bookings.

9.6 Advertising on Business Listings

By listing a business with us, or by claiming an existing listing, you acknowledge and agree that we may display advertising, sponsored content, and third-party affiliate content (such as tours, tickets or nearby-accommodation booking widgets) on directory pages, including on your business listing page. Such content is independent of, and does not affect the accuracy of, the information shown about your business.

10. Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use our service will cease immediately.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Spain. Mandatory consumer protections and statutory jurisdiction rights remain unaffected. Consumers are not required to waive their legal forum.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Existing orders remain governed by the terms accepted when ordered, unless a change is agreed or legally required.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
